the marks could be restrained, unless some means were found of restraining also their use in the Treaty Ports of China.

If legislation were decided upon it would probably take the form of the total prohibition of the use in the Colony of any marks belonging to, or registered in the sole or joint names of, or formerly used solely in the Colony by, any enemy firms.

I am therefore disposed with your permission to grant to Mr. Webb permission to trade with Messrs. Fraser and Richardson while making it clear that no express permission to

use the Trade Marks in question is given or implied.

The policy I advocate is one of non-interfer- -ence where Trade Marks are concerned leaving questions of rights

in such marks to be settled after the war between parties claiming

them.

As it is possible that similar questions have engaged the attention of His Majesty's Government I have thought it better to refer the matter to you before taking any action,

and I have the honour to ask that instructions may be sent by

telegram if possible.
